1. Agreement to These Terms
These Terms of Service ("Terms") govern your use of budtrainer.com (the "Site") and your purchases from us. By using the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site. You must be at least 18 years old, or the age of majority where you live, whichever is greater, to use the Site or buy from us.
2. Our Products and Site Content
We work to keep product descriptions, photos, pricing, and availability accurate, but we do not guarantee that Site content is complete, current, or error-free. Colors may display differently depending on your screen, and products may be modified or discontinued at any time. Articles, guides, and other educational content on the Site are provided for general information only. Growing results depend on factors outside our control, including plant genetics, environment, nutrients, and your skill and technique, and nothing on the Site is a guarantee of any horticultural outcome.
3. Lawful Use of Our Products
Our products are general horticultural tools designed for training, supporting, and growing plants. You are solely responsible for ensuring that your use of our products, and anything you choose to grow, complies with the laws of your country, state, or province. We do not encourage or condone any unlawful activity, and we are not responsible for how you use our products.
4. Orders, Pricing, and Payment
Your order is an offer to buy, and we may accept or refuse it at our discretion. We may cancel or limit orders that appear fraudulent, that are placed by resellers or distributors without our authorization, or that are affected by pricing, inventory, or listing errors. If we cancel an order after you have paid, we will refund you in full. Prices are shown in the currency indicated at checkout and may change at any time, but changes do not affect orders already placed. Payments are processed by third-party payment processors as described in our Privacy Policy. For international orders, you are responsible for any import duties, taxes, and customs fees unless stated otherwise at checkout.
5. Shipping, Returns, and Limited Warranty
Shipping timelines, return eligibility, and warranty conditions are set out in our Shipping Policy, our Refund Policy, and our 12-Month Limited Warranty, all of which form part of these Terms. In summary, most purchases are covered by a 30-day return policy, and our products are covered by a 12-month Limited Warranty against manufacturing defects. Where permitted by law, the Limited Warranty is your exclusive remedy for a defective product, and we will, at our option, replace the product or refund your purchase price. We may decline return or warranty requests that are made in bad faith or that abuse the intent of these policies. If you are a consumer, the Limited Warranty is in addition to, and does not limit, any statutory rights or legal warranties you have under the laws of your jurisdiction.
6. Subscriptions and Pre-Orders
If you purchase a product on a subscription basis, you authorize us to charge your payment method on the recurring schedule and at the price disclosed at checkout, until you cancel. You can cancel at any time through your account on the Site or by emailing hello@budtrainer.com, and cancellation takes effect at the end of the current billing period. Orders already shipped follow our Refund Policy. If we change the price or terms of your subscription, we will notify you in advance, and you can cancel before the change takes effect. If a recurring payment fails, we may retry it or pause your subscription until payment succeeds.
If you place a pre-order or other deferred purchase, the charge timing and estimated shipping window are disclosed at checkout. Estimated ship dates are estimates, not guarantees. You may cancel a pre-order for a full refund at any time before it ships.
7. Accounts
If you create an account, you agree to provide accurate information, keep it up to date, and protect your login credentials. You are responsible for activity under your account. We may suspend or close accounts that violate these Terms.
8. Reviews, Photos, and Other Content You Submit
If you submit reviews, photos, videos, comments, or other content to us, or share content publicly about our products that we ask to feature, you grant BudTrainer a worldwide, royalty-free, perpetual license to use, reproduce, adapt, publish, and display that content in connection with our business, including in marketing, in any media. You confirm that the content is yours, that any factual statements in it are accurate, and that it does not violate anyone else's rights. We may edit content for length or clarity and may decline or remove content at our discretion. We are not responsible for content submitted by users.
9. Intellectual Property
The Site and everything on it, including text, graphics, photos, videos, logos, and product designs, are owned by or licensed to BudTrainer and are protected by copyright, trademark, and other laws. BudTrainer, BudClips, BudCups, BudPots, BudHuggers, and BudTape are trademarks of BudTrainer Inc. Nothing in these Terms grants you a license to use our trademarks or content, except as needed to browse the Site and make personal purchases.
10. Prohibited Uses
You agree not to use the Site or our products for any unlawful purpose, and not to:
- Scrape, harvest, or copy Site content or data using bots or automated tools without our written permission.
- Interfere with the security or operation of the Site, or attempt to access accounts or systems that are not yours.
- Misrepresent your identity or affiliation, including presenting yourself as an authorized reseller or representative of BudTrainer when you are not.
- Upload malicious code or use the Site to transmit spam or deceptive content.
We may restrict or terminate your access to the Site if you violate these Terms.
11. Third-Party Links and Marketplaces
The Site may link to third-party websites and services that we do not control, and we are not responsible for their content or practices. Our products are also sold through marketplaces and retail partners, such as Amazon. Purchases made outside the Site are governed by the seller's or marketplace's own terms, although our Limited Warranty applies to our products as described on our warranty page.
12. Disclaimer of Warranties
Except for the Limited Warranty described in Section 5, the Site and our products are provided "as is" and "as available," and, to the maximum extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, and we do not guarantee any particular growing result, plant health outcome, or yield. To the extent permitted by law, any implied warranties that cannot be disclaimed are limited in duration to the duration of the Limited Warranty. Some jurisdictions do not allow the exclusion of certain warranties or limits on how long an implied warranty lasts, so some of the above may not apply to you.
13. Limitation of Liability
To the maximum extent permitted by law, BudTrainer, its directors, officers, employees, and suppliers will not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or relating to these Terms, the Site, or our products, including lost profits, lost revenue, loss of data, or loss of plants, crops, or harvests, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms, the Site, or our products is limited to the greater of (a) the amount you paid us for the product or order giving rise to the claim, and (b) one hundred Canadian dollars (CA$100).
Nothing in these Terms excludes, restricts, or modifies any consumer right or legal warranty that cannot be waived under mandatory law, including the Ontario Consumer Protection Act, the Quebec Consumer Protection Act, and similar consumer protection laws that apply to you. To that extent, the disclaimers and limitations in these Terms apply only to the maximum extent permitted.
14. Indemnification
You agree to indemnify and hold harmless BudTrainer and its directors, officers, and employees from claims, damages, and expenses, including reasonable legal fees, arising out of your breach of these Terms, your violation of any law, or your misuse of the Site or our products.
15. Wholesale and Business Customers
If you purchase from us as a business, including through our wholesale, distributor, or affiliate programs, any separate written agreement between us governs to the extent it conflicts with these Terms, and consumer protection laws may not apply to your purchase.
16. Governing Law and Disputes
These Terms, and any dispute arising out of them or your use of the Site or our products, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of law rules. You agree that the courts of the Province of Ontario have jurisdiction over any dispute, and you waive any objection to that venue, except where the mandatory consumer protection law of your place of residence gives you the right to bring or defend a claim in your local courts or requires your local law to apply. Before starting any formal proceeding, please contact us at hello@budtrainer.com; most issues can be resolved quickly and informally.
17. Changes to These Terms
We may update these Terms from time to time. The current version will always be posted on this page with its effective date, and changes apply from the date they are posted. Your continued use of the Site after changes are posted means you accept the updated Terms. Changes do not affect orders already placed.
18. Assignment
We may assign or transfer these Terms, and any rights or obligations under them, in connection with a merger, acquisition, financing, reorganization, or sale of some or all of our assets. You may not assign these Terms without our written consent.
19. General
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies they reference, are the entire agreement between you and BudTrainer regarding the Site and your purchases, and they replace any prior versions; any separate written agreement signed between us prevails over these Terms to the extent of a conflict. We are not liable for delays or failures caused by events beyond our reasonable control, including carrier delays, strikes, natural disasters, or government actions.
